About the TIP Report The Trafficking in Persons (TIP) Report is published annually by the US Department of State, mandated by the Trafficking Victims Protection Act (TVPA) of 2000. It evaluates the efforts of 188 countries and territories to combat trafficking. The tier rankings reflect government efforts to meet the TVPA’s minimum standards for the elimination of trafficking; not the size of the country’s trafficking problem.

Tier 1

Countries whose governments fully meet the TVPA’s minimum standards for the elimination of trafficking. This does not mean trafficking does not exist in these countries; it means the government is making strong, sustained efforts including prosecution, protection, and prevention. Tier 1 countries are expected to maintain or improve efforts year over year.

Tier 2

Countries whose governments do not fully meet the TVPA’s minimum standards but are making significant efforts to bring themselves into compliance. These countries have acknowledged their trafficking problems and are taking concrete steps, but gaps remain in prosecution, victim protection, or prevention.

Tier 2 Watch List

Countries placed on the Tier 2 Watch List meet the criteria for Tier 2 but also meet one or more of the following: (a) the absolute number of trafficking victims is very significant or increasing; (b) there is a failure to provide evidence of increasing efforts from the previous year; or (c) the determination that significant efforts are being made is based on commitments to take future steps. Countries may remain on the Watch List for a maximum of two consecutive years before being downgraded to Tier 3 (with limited waivers).

Tier 3

Countries whose governments do not fully meet the minimum standards and are not making significant efforts to do so. Tier 3 countries may face sanctions including the withholding of non-humanitarian, non-trade-related foreign assistance. The President may also instruct US executive directors of multilateral development banks to vote against loans to Tier 3 countries.

Consequences of Tier Rankings

Tier rankings carry real diplomatic and financial consequences:

  • Tier 3 sanctions: The US may withhold non-humanitarian, non-trade foreign assistance. The President may instruct US directors at the IMF and World Bank to vote against loans to Tier 3 countries.
  • Diplomatic pressure: Countries approaching a downgrade often accelerate reforms; the TIP Report is widely cited as the most effective diplomatic tool against trafficking.
  • Watch List cap: Countries cannot remain on the Tier 2 Watch List for more than two consecutive years without being downgraded to Tier 3 (subject to limited presidential waivers).
  • US self-assessment: The US has ranked itself at Tier 1 since including itself in the report in 2010, though advocates have criticized this as overly generous.

Criticisms of the TIP Report

  • Political influence: Rankings sometimes appear to reflect geopolitical alliances rather than purely anti-trafficking performance. Allies may receive more favorable treatment.
  • Measures effort, not outcomes: The system evaluates government efforts, not actual prevalence or reduction of trafficking.
  • US self-assessment: The State Department assessing its own country’s performance creates an inherent conflict of interest.
  • Narrative over data: Country narratives are largely qualitative, making comparisons between similarly ranked countries difficult.
